• "Services" — legal and advisory services provided by the firm, including the Listening Appointment, Mediated Agreement Drafting, and Long-term Family Representation.
• "Engagement Letter" — the written agreement entered into when a formal service is engaged.

Our services are intended for persons aged 18 and over who have the legal capacity to enter into an agreement. Use of our website by minors is not permitted without the involvement of a parent or guardian.

3. Description of Services

Kasih Counsel provides family law services in Malaysia, with a primary focus on matters arising in Johor and the surrounding region. Our current services are:

• Listening Appointment (RM 480) — an initial consultation in which we listen to your situation and prepare a short written note in plain English outlining the position. There is no expectation to proceed further unless you choose to.
• Mediated Agreement Drafting (RM 1,160) — drafting and review of mediated agreements covering divorce, custody, and financial provision. One round of revisions is included at no additional cost.
• Long-term Family Representation (RM 1,890) — a full engagement for matters requiring ongoing support, including court representation, mediated review, and correspondence with other parties' representatives.

Availability of services may vary depending on capacity and the nature of your matter. Geographic service delivery is primarily within Johor, Malaysia, though we may act in other jurisdictions by separate agreement.

4. User Responsibilities

When using our website or engaging our services, you agree to:

• Provide accurate, complete, and up-to-date information in any form or communication.
• Use the website only for lawful purposes and in a manner consistent with applicable Malaysian law.
• Refrain from transmitting any content that is offensive, misleading, or harmful.
• Not attempt to interfere with the operation of our website or gain unauthorised access to any system or data.
• Notify us promptly if any information you have provided changes during the course of an engagement.

5. Intellectual Property

Documents and written notes prepared by us in the course of a service engagement remain the intellectual property of the firm until all fees in connection with that engagement have been settled in full.

6. Fees and Payment

Fees for each service are set out on our website and in the engagement letter issued before work commences. All prices are stated in Malaysian Ringgit (RM) and are inclusive of any applicable taxes unless stated otherwise.

• Payment terms will be specified in the engagement letter.
• We accept payment by bank transfer and other methods notified to you at the time of engagement.
• Where the scope of work changes materially, we will discuss revised fees with you before proceeding.
• Refund requests are considered on a case-by-case basis, taking into account work completed at the time of any cancellation.

7. Confidentiality

We treat all information shared with us in the context of a professional engagement as confidential. This obligation continues after the conclusion of any engagement. Please refer to our Privacy Policy for details of how personal data is handled.

Information shared through our website contact form prior to an engagement is treated with the same discretion, though it does not create a solicitor-client relationship until an engagement letter is signed.

We reserve the right to decline or discontinue services to any person where professional obligations or applicable law require it.

Provisions of these terms that by their nature survive termination — including those relating to intellectual property, confidentiality, limitation of liability, and dispute resolution — will continue to apply.

12. Dispute Resolution

These terms are governed by the laws of Malaysia. Any dispute arising out of or relating to these terms or our services shall first be referred to informal resolution between the parties.

If informal resolution is not reached within 30 days, the matter shall be submitted to mediation in Johor Bahru before any court proceedings are commenced. Where mediation is unsuccessful, disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia.

13. General Provisions

• Entire agreement: These terms, together with any engagement letter, constitute the entire agreement between us on the matters covered.
• Severability: If any provision is found unenforceable, the remaining provisions continue in effect.
• Waiver: Failure to exercise any right under these terms does not constitute a waiver of that right.
• Assignment: You may not transfer your rights or obligations under these terms without our prior written consent.

14. Changes to These Terms

We may update these terms from time to time. When we do, we will publish the revised version on this page and update the effective date at the top. Continued use of our website after a revision constitutes your acceptance of the updated terms.
